The time is 12:00, March 14,2006. We're at the Snohomish County Jail.
also present in the room is investigator Thrasher, and we have
you tell me if you know that you are being taped?

l

can

Yes
And you have given me authorization to tape you?
Yes
Alright - would you go ahead and tell me about your relationship with, l1l11
Stephanie
Yes

Aguirre
Yes
Will you start from the first, please?

Ok, on the first *********, I was taken to WCCW in 2002. I was put in -- this is all the closest
I can to ****.** and stuff. I know that I met Stephanie Aguirre in probably August of that same
year - 2002. She was my counselor in J unit, and we immediately began having meetings about
getting ajob, take your LSI score and stufflike that. Our initial, I guess, uh, what I can say, just
off the *.**. * ** I know that it took days for me to get my LSI done - some of the ***-*
inmates, new inmates, made fun of it or something to the office, rest ofthe office. It's not that
big of a deal, and I did hit it off pretty good with Stephanie Aguirre. We had kind of an
interesting sparring" *"*'" *"". here and there in her office, you know?
Like what?
Oh, she'd always give me a bad time for whatever I was doing in the units, and we just - we
talked a lot, but we talked a lot - the eo le that were there that would have a mental note of it,
and~uld, would be
ros ibly
, an~Oh,
an~would know would say I was some kind of pel'Vert stalking
her, you know
Ok
But she wasn't there a lot of times and it was ***** - I think it was a Jot of trips to the officeespecially at count time, she'd call me in her office. After I was, say, 4 or 5 visits to her office,
she told me she was very attracted to me, and it was hard to talk to me with a straight face. It
was hard but, as we're sitting here, **.-** on the side and the other'side, the windows, just like
they're in here, behind me, and that's where the inmates and officers could see us. And she

0526

would always say it's hard for her to sit there, because she couldn't - you know, she'd have
expressions on her face that she thought were not appropriate, and she had to try to keep her
focus in her work or her computer because of * ** *"***. ] knew it was odd, and I was really
uncomfortable at first] think -] don't know how - I'm trying to put myself back in that time,
but] also remember thinking to myself, well, hmmmm. What he asked me was if] was a free
person, and] wasn't, a felon, you know, a convict in prison, if] would have coffee with her.
And I said yes.
How soon into this was that?
A month
A month or so?
Yup

And you said yes?
] said yes, ] said yes, oh yes - and] said, um, ] said] know you're police and all that, but, you
know, we can be friends and I could see you at Starbucks, we could get a coffee ******** being
friends. And, yeah, it was odd. And she began writing me things that weren't appropriate - gave
me a poem she had written, and began telling me she was thinking about me, dreaming about me.
Do you have any of those?
Ah, I don't think so... usually , she, she made sure I got rid of everything ********* I do have
the poem - it should have been in that book. OK I gave ******* that. Urn, in fact, he's written
it with some group she was in or something with some younger people. Anyway ... So, anyway,
now let me tell you about December of that year. She went to visit my mother at my aunt's
house in Tacoma.
In ********? or...
hanie went was
- or no,
sorry, wrong
'********** and I remember thinking, and my mom
said I had an unusual visitor last night - and,I'm nqt kidding you, I could not believe it. You
know, she went, she wanted to hear, you know, and'my mom thinks, I don't know what you're
doing in there. The lady was really nice, and she seems to really care about you, but this is kind
of like the extra mile with this counselor business, you know. And my aunt felt that she was a
fruitcake. My mom, I guess ...
What did they talk about? Do you remember?
My mom said they talked about little anecdotes from when I was younger, she wanted to hear all
about me, she wanted to see photo albums, stuff like that

0527

Now, was she saying she was there because of her job? Or, do you remember? Has your mom
told you about that?
Yeah, I hate to just make up a bunch of crap, you know ....
No don't make up - only if you know,
1lmow -1 know the part about the photos that ***** and I know the part that my aunt said she
wanted to bear little stories about when I was little, and it was creepy. You know.
Ok - only tell me what you know.
Ole But I'll also tell you this, you know, 1 don't know how thrilled my mom is going to be to be
involved in this ...
Well, she'll be in here shortly, then
Right, but 1 know that you can expect her to be real straight with you and tell you exactly -my
mom has got a good memory. So - it should be helpful. They should be home by now.
Ok
Ok. Anyway, so 1 did, uh, I did use my, I don't know how I'd call it - that's fine -my little
frienliishi
with the police lady -l didn't use that for wanting to be moved to the neighboring unit
with
.
Ok
And, ah, that happened,
And did she know that's why you wanted to be moved?
Oh, no - not at this time. And when she did find out, she came storming into K unit and there
was a temporary guy there that day, which was good for her, and for me.
Um, hum
Don't even know who it is - he's a nobody.
Ok
A big, confused man - that's what he was that day with all those women running around, you
know *********. Anyway, she came there and uh - it was after had I had a todoo -l had a
had made some nasty comments about me
****** - I had a little outburst at this
walking down the hallway, about, uh, well she ********** my mother, which didn't have
anything to do with the conversation. I had had it, so like 1 gave a little lunge at her and, uh, they

0528

ended up taking me to seg to calm down. You know, so ] went to seg, spent the night, Lt. Brees
let me out the next day - it was great, it was Sunday, ] really wasn't going anywhere, and she
knew it really wasn't my MO and she let me go back to my room. That was great. Monday,
when Stephanie came to work, she came slipping out (?) over to K unit- she said come in the
back with her - ] went in the back where the refrigerator is and all that - that back thing, and she
asked me what happened, and why, and then, her main ask was she had heard through inmates
that~as not my co-defendant, she was my girlfriend, and that she had been played. Yup
- she was rea] mad.
What did you tell her?
] denied it - that she had been played ********** ******** at the time. Actually, I mean]
think, but, ah ... ] don't know. That's what] did. ] know] was.I know I was being
manipulative, and at the same time, well, kind of enjoying it. ] mean, ] ** **********and then
she said no, I mean, when you're me, and you're at 19 felony points, and you've been to prison
three times, and this lady that seems so together, you know, she was going to help me - she said
I can help you, I can be good for you, I'm the best thing for you - I mean, I, you know, we can
make a life together - you'll be off dope for three years, blah, blah, blah - and I really thought
that she meant it. Fuck her. Just when I think I'm being a manipulator, too, I'm being
manipulated!
And what happened after that?
Well after that, when I was in K unit, we talked sometimes on the sidewalk, stuff like that - that
was about it - we tried to keep it reaJly low because inmates were already talking.
Was there any contraband brought in to you?
Huh?
Did she bring anything in to you?
No
Nope?
No
Never?
Never
The whole time you were there? There's
that you were listening to one day.

aMatchbox 20 cassette] thought she brought in to you

0529

Oh no - that was a matchbox ****** No, it was a Matchbox 20 CD and she bought it, and we
listened to it in her office,
Ok - she didn't buy it for you - she just let you listen to it whenever.
That's right
Was any makeup or anything brought in?
Hardly ever wear makeup - no.
All the girls wear makeup.
I don't - nope
No food?
Nope - nothing
She never shared any food with you?
Nope
Ok, so you indicate ********* in July you say, no, she's just a friend.
Right - but you know what I told her? I just told her ******* ***** the truth, you know? I was
aware ****** with_and it was inappropriate. My behavior was inappropriate,"
knew it was weird, you know, an inmate would come out and she'd say, you know, where's
_at? She's in there with that counselor. And ~uld just have a fit. Well, go in there
~et her. ************** And then pretty soo~nd Stephanie are sharing glaresbetween the gate and stuff like that, you know. Stephanie would look at her ****** tension,
there was an issue ***** So anyway, I was released then in January of '04 - I was released on

my mom several times throughout the year - telephone calls. And my mom would give me

her as soon as ] got out. Well, as soon as ] got out, ~ out to - "***** you messed this up
by herself, you know, I walked out to my mom an~ Well Stephanie was in public access
that day ...
I remember that.

And she thought that _was my sister. And~ been out for a while now, and been
of a different look when they're free, but you know, my sister?

iiiiie"bh

0530

seven, Uh, so, it was my morri and my girlfriend and we went to Issaquah, and then, let's see,
well I can tell you exactly the date - we met in Moses Lake on February zs" and stayed at the
Best Western, J believe, room 224.
Did she pay for it, or did you'!
Yes - she paid for it.
How'd she pay for it? Did you go in with her, or.. .

No - she had it already paid for when J got there. She's not a good girl- it will be on the
computer (?) And ******* called up, um, Hallmark Inn, or Landmark Inn, or something like
that - anyway, we had dinner at Kadie's Restaurant - we had steak with crab on it, hollandaise
sauce, we had 2 or 3 drinks each, we went back to the hotel room and she pulled out her personal
stash, and we got high.

*******
Marijuana
, Marijuana?

Urn hum.
Did you do doobies or pipes, or what were you using?
She had a really fancy pipe. Blue - some kind of pipe I've never used. With a DOC button on it
******** (laughing) Cop *********** no, no, no, just making fun.
So you got high, and then what?
And then we slept together.
Slept together.
Right.
So you had sex
Yes

,

".

How many times did you have sex that night, do you think?
Several - we were asked to be quiet.
Ok. And did she instigate it, or did you instigate it?

0531

Oh, ********** she was very, ah, very aggressive. J mean she didn't -I didn't say no, cause
she -I would, J would never ********* instigate *********isn't interested. You know, But
anyway, so that's what happened, and, urn, the very next month, one month from then,l went to
her home ...
Where was that at?

in_

where she is now. And, ah,
That was her home i~ before she got the apartment
in fact she had a bad day, her son_had - the cops had come to her door, and that he'd taken
her car - or the car she had given ~rother, he had taken it out for a test drive and got himself
caught up with the police and she had a bad day with all that. So she wanted to see me, so J went
to her house.
So you drove all the way from, uh...
Yeah
Ellensburg? From Ellensburg?
Yup.
She called...
No, no - at the time J was in Spokane then.
You were in Spokane - you drove all the way from Spokane to her house.
Yup,

She called you from her house in ...

J talked to her at work. J talk to her at work all the time.
What do you mean - at the institution?
Yup.
So you essentially call into the institution.
Oh yeah - constantly. ************Yup, urn hum. And so, let's see, I was in Spokane, we met
in Moses Lake, we try to meet halfway, and then, well, I was coming to see my parents anywaynot that 1 wouldn't have driven, you know, anyway -I was coming to the Westside anyway to
see my mom. And I saw Stephanie. In fact, let's see, oh -I did not go over to her house, we met
at mom's, in Issaquah. She's already met mom - she already met my mother before.

0532

Where at?
At my house, and, um, now she is meeting my mom, and my mom's new husband. He also
bakes ('I) fruitcake """""""""" I like it, my mom loves it. Good for him, he likes that. But

that's where Stephanie came, and we left my car and took her car.
And where'd you go?
To her house.

In"

In ...

Yup. And I spent the night with her there.

Were her kids there?
Urn, let's see, not this time.
Where were they? Any idea?
Um, o~as at the neighbor friends - we had to be careful in her neighborhood, because
some of the other DOC people lived around there. So she was real reluctant for us to be hanging
out in that neighborhood.
.
So you spent the night and you had sex again?
Oh yeah. And she had ... and-'as there and we went to Daniel's Broiler and we went
ft:om mom's - sorry ,,"""",," - from mom's to BelleV,ue to Daniel' ~ and I took her to
dinner, and then we went to her place. And she called and said c~st stay there for the
night and the people said yes and then the next morning, we went to get him and we all ate
breakfast *** ,, ,

And the older one, do you know where she lives?

an~

She lives with Stephanie.
Does she?
Urn hum. She was back in Alabama, but she was involved, she was involved in a, she was a

witness to a murder. And it was really ugly. They got rid of her. They had her testify and sent
her back here. A really ugly, bad ...
And what timeframe is all this going on, ********
Ah, this was in, this was March of 2004.
Ok

Ok. And then I saw her again other times and she moved out to - I can't think of what the name
of the apartment building is - but she lives in J 01. The bottom.

********
And do you ever go there?
Oh, yeah.
And spent the night with her?
Yeah - often - l' ve been there a few times and spent the night with her.
So total do you know many times you might have been with her

*********

Urn, six.
Six?
Uh huh. Different occasions, yeah. And she's been to my mom's inlssaguah a couple timesmaybe three times. We've met there. And also, one day, she had to go to a, well, she's at
McNeil now, of course, so she had to leave McNeil and go to Kent for something to do with
work, so we met in Issaquah just for coffee and lunch. So we go to this one place we went to
quite often, in Issaquah, on the river, an Italian place - God,ifl could only think of the name of
it - something on the river. Anyway, our waiter was Noah - he'll remember us.
Italian place on the river.
Urn hum.

***********

0535

He blew we were, he knew we were there together, and

So things are going well, and you're seeing each other off and on .
Urn bum.

Then what happened?
Ah - my girlfriend decided I wasn't going to be seeing her any more. And that she didn't find it
appropriate that Stephanie would be calling our home.
And when was this?
That was last summer. Summer of '05. Or, excuse me - yes - Summer of '05.
June, July, August?
