Board Meeting October 16, 2007 Agenda Item 3 (Revised) Attachment 3 CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD Resolution 2007-212 (Revised) Consideration Of Action For Noncompliance With The 50 Percent Diversion Mandate By: 20th District Agricultural Association; 7th District Agricultural Association; Calipatria State Prison; San Quentin State Prison; Compton Community College; 21st District Agricultural Association; California Institution For Men, Chino; And Richard J. Donovan Correctional Facility WHEREAS, Public Resources Code Section 42921 (b) mandates that reporting State agencies and large State facilities must meet a 50 percent diversion goal by January 1, 2004. WHEREAS, Following the preparation and submittal of this agenda item, San Quentin State Prison and the 20th District Agricultural Association have both submitted statements and documentation supporting achievement of the 50 percent diversion mandate; and WHEREAS, the 7th District Agricultural Association; Calipatria State Prison; Compton Community College; 21st District Agricultural Association; California Institution For Men, Chino; And Richard J. Donovan Correctional Facility have submitted their annual report; however, the submitted reports show noncompliance with the 50 percent diversion mandate; and WHEREAS, Compton Community College; 21st District Agricultural Association; California Institution For Men, Chino; and the Richard J. Donovan Correctional Facility have not shown compliance with the 50 percent diversion mandate for two or more consecutive years; and NOW, THEREFORE, BE IT RESOLVED that San Quentin State Prison and the 20th District Agricultural Association have both met the requirements of Public Resources Code, Section 42921 et. sec.; and NOW, BE IT FURTHER RESOLVED that the 7th District Agricultural Association; Calipatria State Prison; Compton Community College; 21st District Agricultural Association; California Institution For Men, Chino; And Richard J. Donovan Correctional Facility have not shown that the 50 percent diversion mandate has been achieved as required by Public Resources Code, Section 42921 (b); and NOW, BE IT FURTHER RESOLVED that staff shall place the noncompliant State agencies and large State facilities identified above on the noncompliance section of the California Integrated Waste Management Board’s Enforcement Orders and Actions website; and Page (2007-212 (Revised)) NOW, BE IT FURTHER RESOLVED that Board staff and, as appropriate Board leadership, shall meet with the leadership of the noncompliant State agency/facility to discuss appropriate steps to take to achieve the mandated diversion and that, upon completion of the leadership meeting, program staff shall review the necessity of the agency/facility developing and submitting a modified Integrated Waste Management Plan; and NOW, BE IT FURTHER RESOLVED that Board staff shall develop a letter to the Legislature and Governor, signed by the Board’s chair, reporting the noncompliance with the 50 percent diversion mandate.
